Ley otorga ciudadanía automática a ciertos menores nacidos en el extranjero

La mayoría de los estadounidenses obtienen la ciudadanía estadounidense al momento de nacer o a través de la naturalización. Sin embargo, hay ciertas personas que nacieron en el extranjero que pueden obtener la ciudadanía de forma automática.

En este artículo el Gobierno explica cómo funciona Ley de Ciudadanía de Menores del Año 2000, la cual otorga ciudadanía automática a niños de padres que son ciudadanos estadounidenses ya sea por nacimiento o adopción. Cómo obtener la ciudadanía automática En general, la Ley de Ciudadanía de Menores del Año 2000 beneficia a menores que nacieron en el extranjero, son menores de 18 años de edad y tienen por lo menos un padre que es un ciudadano estadounidense.

Para cumplir con los requisitos de la ciudadanía estadounidense automática bajo esta ley, se debe: Cumplir con la definición de “menor” según las leyes de inmigración Tener menos de 18 años de edad Tener por lo menos un padre que sea ciudadano estadounidense por nacimiento o naturalización Residir en los Estados Unidos y estar bajo la custodia física y legal del padre que es ciudadano estadounidense Ser residente permanente legal de los Estados Unidos.

En caso de adopción de un menor, es necesario probar que la adopción cumple con todas las leyes migratorias. “Debido a que las leyes de ciudadanía han cambiado en los últimos años, sólo tomaremos en cuenta la ley que estaba vigente antes de que el menor haya cumplido los 18 años para decidir si obtuvo la ciudadanía”, dijo Mariana Gitomer, una oficial del Servicio de Ciudadanía e Inmigración de Estados Unidos (USCIS, por su sigla en inglés).

Trámites adicionales para comprobar ciudadanía Los menores que son ciudadanos estadounidenses bajo esta ley no necesitan solicitar la ciudadanía. No obstante, para obtener un certificado de ciudadanía como evidencia de su estatus legal, deben presentar el formulario N-600. Una vez que se presente el formulario un oficial de inmigración determinará si una entrevista es necesaria.
